Skagit County Courthouse. From http://www.countycriminal.com.

News outlets in the Seattle area are reporting that Skagit County has filed burglary and theft charges against Camano Island native Colton Harris-Moore.

Remember the plane he stole and flew to Orcas Island while a fugitive? Yep. That’s what this is about. This is not double jeopardy or “reaching” or an injustice or misuse of the legal system like some are already lamenting online. These were charges that were filed before, as KOMO says, then dropped to allow for a plea deal in other cases, and have been filed again. (more…)

From KOMO News (http://www.komonews.com/news/local/Barefoot-Bandit-emails-ridicule-law-enforcement–137990673.html):

SEATTLE (AP) — “Barefoot Bandit” Colton Harris-Moore ridiculed police and prosecutors in emails and phone calls from prison recently, undercutting his claims that he’s sorry for his two-year crime spree, the U.S. attorney’s office said in court documents filed Tuesday.

In these emails, KOMO says, Harris-Moore allegedly called police, prosecutors, and reporters swine, vermin, and fools in direct contradiction to his previous “apology.” He bragged about his crime spree and obviously believes, in true narcissistic form, that he is above other people:

“The things I have done as far as flying and airplanes goes, is amazing,” he wrote in one email last August. “Nobody on this planet have done what I have, except for the Wright brothers.” (more…)

Barry Goldwater once said that moderation in the pursuit of justice is no virtue. As I sat down to type out my thoughts on Colton Harris-Moore’s sentencing today, that is the quote that comes to mind.

I am not disappointed that a miscreant of this magnitude has been sentenced to seven years in prison and has yet to be sentenced for federal charges. What I am disappointed in is how easily the public and our legal system can be manipulated into believing that a serial criminal is a victim. (more…)

Today KING 5 reported that Pam Kohler, Colton Harris-Moore’s mother, has asked for production on a movie about his exploits to be stopped until she gets $300,000: http://www.king5.com/news/local/Colton-Harris-Moores-mom-reacts-to-plea-deal-Report-124439864.html.

Kohler says that she was promised $300,000 and is taking legal action to make sure she gets it. If there is a legally binding agreement that ensures she gets the money, she obviously has a right to do this. But it makes me sick, just sick, that she is still behaving so casually about her son’s crimes and can profit from them. She encouraged some of them, remember. (more…)

Money

http://dcfederaldefenseattorney.com/2011/06/01/barefoot-bandit-criminal-forfeiture-rule-32-2b-of-the-federal-rules-of-criminal-procedure/

Federal defense attorney Erich Ferrari has posted a good explanation of criminal forfeiture law on his blog. I hadn’t seen a technical explanation in the local media  of how Colton Harris-Moore can “give up” money he doesn’t yet have, and this explains it clearly.

Dishonest

Martha Stout, author of The Sociopath Next Door, said, “The most universal behavior of unscrupulous people is not directed, as one might imagine, at our fearfulness. It is, perversely, an appeal to our sympathy.”

I find it very disturbing when people fall for this mind game, a trap that low to no conscience types and their defenders instinctively set when cornered. Finding themselves in the hot seat, they divert onlookers’ attention from their misdeeds to all other possible causes of their behavior, including how society, their parents, their education, and their uncle’s former college roommate’s cousin’s deranged hedge trimmer-wielding hamster all have responsibility for their “mistakes”. Heaven forbid they should have to take responsibility for their own choices. (more…)

Brain Diagram

I just posted this on another blog that asked what we could be doing to encourage Colton Harris-Moore to live a more responsible life. Feel free to join the discussion at http://catchthebarefootbandit.wordpress.com/. Healthy, respectful discussions can lead to great things.

I’m fine with being the lone dissenting voice on this view if that winds up being the case. I’ll stick to my guns about Harris-Moore needing an in-depth evaluation by a qualified forensic psychologist for the public’s sake as well as his own. This should factor into his sentencing, along with expert testimony. (more…)

CBS 48 Hours

Tonight’s episode of CBS’ 48 Hours was about Washington’s own Colton Harris-Moore.

There had been little about Harris-Moore in the media lately until he was indicted on five federal charges this week. He’ll be arraigned next Thursday.

I tried to keep an open mind while watching this 48 Hours episode, but it was hard to do so when this guy stole an assault rifle from a deputy’s car a block from my weekend home at the time. It was also unsettling to know that someone with no regard for others’ property was running around in the woods nearby. (more…)

Truth Lies

http://www.komonews.com/news/local/98570694.html

It has become quite clear that Pam Kohler and Colton Harris-Moore plan on profiting from his crimes. Today KOMO reported that one of their attorneys is investigating “defamation” against his clients as well.

So not only do they want to make money off of people’s misery, now they might want revenge– for what he caused and she might have enabled. (more…)

Law Books

Many media outlets have been reporting that Washington doesn’t have a Son of Sam law. That’s not true. How effective it will be in the Colton Harris-Moore case is another question.

RCW 7.68.200: http://apps.leg.wa.gov/rcw/default.aspx?cite=7.68.200

A Son of Sam law prohibits criminals and their representatives from profiting from their crimes. New York enacted the first Son of Sam law in 1977 to prevent the law’s namesake, serial killer David Berkowitz, from making money off of the random murders he committed. (more…)
